Jaalva Copyright & DMCA Policy

Jaalva expects users to respect the copyrights and intellectual-property rights of others.

You should upload, livestream, publish, or otherwise share content only when you own the necessary rights or have appropriate authorization or another lawful basis for using the material.

Jaalva may remove or disable access to content when we determine that removal is appropriate in response to a copyright complaint, legal obligation, court order, or other valid rights concern.

If you believe that content available through Jaalva infringes a copyright that you own or are authorized to enforce, you may submit a copyright complaint.

Your complaint should identify the allegedly infringing material with enough detail for Jaalva to locate and evaluate it.

Submitting a copyright complaint does not guarantee removal. Jaalva may review the request, request additional information, or determine that additional legal or factual review is necessary.

To help Jaalva process a copyright complaint efficiently, your notice should include:

• Your full legal name and contact information.
• Identification of the copyrighted work that you believe has been infringed.
• If multiple copyrighted works are involved, a representative list of those works where appropriate.
• Identification of the content on Jaalva that you believe is infringing.
• Information reasonably sufficient for Jaalva to locate the allegedly infringing material, such as a Jaalva username, video URL, livestream URL, content identifier, or other specific location.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate.
• A statement, made under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

Depending on the circumstances, Jaalva may:

• Review the reported material.
• Request additional information from the complaining party.
• Remove or disable access to the reported content.
• Notify the user who submitted the content.
• Preserve relevant information when reasonably necessary for legal, safety, or dispute-resolution purposes.
• Take action against an account when appropriate under Jaalva's Terms or Community Guidelines.

If Jaalva removes content following a formal copyright notice and applicable law provides a counter-notification process, the affected user may be permitted to submit a counter-notice.

A valid counter-notice generally needs to identify the removed material, explain why the user believes the material was removed as a result of mistake or misidentification, provide appropriate contact information, contain the statements required by applicable law, and include a physical or electronic signature.

Jaalva may provide additional instructions when a counter-notice process is available for a particular matter.

Content removed in response to a copyright complaint is not automatically restored merely because a counter-notice is submitted.

Where applicable, Jaalva may restore content after the legally required waiting period unless the complaining party informs Jaalva that appropriate legal action has been filed to restrain the allegedly infringing activity.

Jaalva may restrict or terminate accounts that repeatedly infringe copyright or repeatedly upload material that results in valid copyright enforcement.

Jaalva may consider the number, nature, timing, context, and reliability of copyright complaints and other relevant information when determining whether repeat-infringer enforcement is appropriate.

Severe or deliberate infringement may result in immediate enforcement without prior warnings.

Copyright complaints and counter-notices must be submitted in good faith.

Do not knowingly make materially false claims of copyright infringement or materially false counter-notifications.

Jaalva may restrict users who intentionally abuse copyright-reporting systems to harass creators, suppress lawful speech, or manipulate moderation processes.

False copyright claims may also expose the sender to legal consequences under applicable law.

Copyright ownership does not prohibit every use of a copyrighted work.

Uses involving criticism, commentary, news reporting, teaching, scholarship, research, parody, or other purposes may qualify for fair use or another legal exception depending on the circumstances.

Jaalva may consider relevant context when reviewing a copyright complaint but does not provide legal advice or make binding judicial determinations regarding fair use.

Copyright rules apply to livestreams just as they do to uploaded content.

Creators are responsible for having the rights needed to intentionally broadcast copyrighted music, video, television, movies, games, performances, artwork, or other protected material.

Jaalva may end or restrict a livestream when reasonably necessary to address a valid copyright complaint or legal obligation.

Ownership of a video, recording, or livestream does not automatically provide the rights to every song, composition, sound recording, or performance included in that content.

Creators are responsible for obtaining any licenses or permissions required for music they intentionally include in their content.

Jaalva's ability to technically transmit a piece of content does not mean Jaalva has granted the creator a license to use third-party copyrighted material.

Jaalva does not claim ownership of User Content merely because it is uploaded or broadcast through the Service.

The license granted to Jaalva under the Terms of Service allows Jaalva to host, process, transmit, display, moderate, and operate User Content as needed to provide the Service.

Before Jaalva's public launch, Jaalva intends to establish and publish designated-agent contact information for formal notices of claimed infringement.

Jaalva also intends to register the designated agent through the U.S. Copyright Office's electronic designation system where appropriate.

Once that process is complete, this section will be updated with the official agent's name or designated role, mailing address, telephone number, and email address.

Copyright owners, creators, or their authorized representatives may submit copyright concerns during Jaalva's closed pre-alpha to:

This pre-alpha contact address should not be interpreted as a representation that Jaalva has completed designation of a DMCA agent with the U.S. Copyright Office.

Jaalva will publish its formal designated-agent information after that process has been completed.

Jaalva may update this Copyright / DMCA Policy as the Service develops, our copyright procedures change, or applicable legal requirements change.
