Jaalva Terms of Service

Welcome to Jaalva.

These Terms of Service ("Terms") govern your access to and use of Jaalva, including its websites, applications, livestreaming features, video-sharing features, community features, and related services (collectively, the "Service").

Jaalva is currently operated by an individual operator located in the State of Arkansas, United States ("Jaalva," "we," "us," or "our"). Jaalva is presently operating as a closed pre-alpha service and has not yet launched to the general public.

By creating an account, accessing the Service, or using Jaalva, you agree to these Terms and acknowledge our Privacy Policy and Community Guidelines.

If you do not agree, do not use Jaalva.

Jaalva is currently under active development.

Pre-alpha users should expect bugs, incomplete features, interruptions, loss of functionality, changes to features, and temporary or permanent service outages.

We may modify, suspend, reset, restrict, or discontinue any portion of the pre-alpha Service at any time.

Pre-alpha accounts, content, settings, statistics, usernames, follows, messages, livestream information, or other data may be modified or deleted as part of testing, maintenance, security work, or development.

Participation in the pre-alpha does not guarantee access to future alpha, beta, or public versions of Jaalva.

During the closed pre-alpha period, creation of a Jaalva account requires a valid invitation code.

Invitation codes are issued individually and are intended for a single account unless Jaalva expressly states otherwise.

You may not sell, trade, publicly distribute, duplicate, manipulate, or attempt to circumvent Jaalva's invitation system.

We may revoke an unused invitation or restrict pre-alpha access at our discretion, including for security, abuse prevention, testing capacity, or violations of these Terms.

You must be at least 13 years old to create or use a Jaalva account.

Jaalva does not support accounts for children under 13.

You must provide accurate information concerning your date of birth.

Users who have not reached the age of majority where they live may only use Jaalva when permitted under applicable law and subject to any consent requirements applicable to them.

Jaalva may restrict access, require additional age or consent verification, or disable an account when reasonably necessary to comply with applicable law.

Certain content or features may have higher age requirements, including content designated as mature or restricted to users 18 or older.

Providing a false date of birth or attempting to circumvent an age restriction may result in account suspension or termination.

You are responsible for maintaining the security of your account and login credentials.

You agree to provide accurate account information and keep it reasonably current.

You may not impersonate another person, fraudulently represent an organization, access another user's account without authorization, or create accounts for abusive or deceptive purposes.

You are responsible for activity conducted through your account except where applicable law provides otherwise.

Notify Jaalva promptly if you believe your account has been compromised.

Jaalva allows users to create, upload, livestream, publish, comment on, and otherwise share content ("User Content").

You retain ownership of your User Content.

By submitting User Content to Jaalva, you grant Jaalva a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, distribute, and technically modify that content as reasonably necessary to operate, provide, secure, moderate, and improve the Service.

This license does not transfer ownership of your content to Jaalva.

You represent that you have the rights necessary to upload or broadcast your User Content and that doing so does not violate applicable law or the rights of another person.

When your content is deleted, Jaalva will cease using it except where temporary copies, backups, legal obligations, safety records, or other legitimate operational requirements require limited retention.

Users may be able to broadcast live audio and video through Jaalva.

You are responsible for everything you intentionally broadcast through your account.

You must have appropriate permission from people whose private communications or activities you intentionally broadcast where consent is legally required.

Jaalva may interrupt or terminate a livestream when necessary to enforce these Terms, the Community Guidelines, applicable law, or platform safety requirements.

Livestreams may also be temporarily processed by Jaalva's infrastructure and service providers as necessary to deliver the stream.

Jaalva does not presently promise permanent VOD retention of livestreams.

Jaalva is intended to support lawful creative expression, including certain mature content.

Content permitted on Jaalva must nevertheless comply with applicable law and the Community Guidelines.

Jaalva may classify content as General, Mature, Restricted 18+, or use similar classifications.

Users must not intentionally mislabel content to circumvent an age restriction.

Age-restricted content must not be intentionally provided to users who do not satisfy the applicable age requirement.

The existence of an age-restricted category does not mean that all adult, explicit, dangerous, abusive, or otherwise objectionable material is permitted.

• Violate applicable law.
• Exploit or sexually abuse minors.
• Distribute child sexual abuse material.
• Make credible threats of violence.
• Engage in unlawful harassment or stalking.
• Publish another person's highly sensitive private information without authorization.
• Facilitate human trafficking or sexual exploitation.
• Commit fraud or impersonation.
• Distribute malware or malicious code.
• Unlawfully access accounts, systems, or data.
• Intentionally interfere with Jaalva's infrastructure.
• Evade account suspensions, bans, or safety restrictions.
• Infringe intellectual-property rights.
• Manipulate Jaalva's systems through bots, artificial engagement, or unauthorized automation.
• Use Jaalva for other unlawful purposes.

Additional behavioral and content requirements appear in the Community Guidelines.

Jaalva may investigate suspected violations of these Terms or the Community Guidelines.

Depending on the circumstances, Jaalva may remove content, remove live-chat messages, restrict features, mute users in livestreams, remove users from livestreams, issue warnings, suspend accounts, terminate or ban accounts, restrict livestreaming capabilities, or take other reasonable actions necessary to protect Jaalva and its users.

Where available, users may submit appeals through Jaalva's moderation system.

Jaalva does not guarantee that every report will result in enforcement.

Users may report accounts, videos, comments, livestreams, live-chat messages, and other supported content.

Reports must be submitted in good faith.

Knowingly submitting fraudulent or abusive reports may itself violate these Terms.

Jaalva may preserve information associated with reports or enforcement actions when reasonably necessary for safety, security, dispute resolution, legal compliance, or prevention of repeated abuse.

Except for User Content, Jaalva and its associated software, interfaces, designs, graphics, logos, trademarks, and other original materials are owned by or licensed to Jaalva and are protected by applicable intellectual-property laws.

These Terms do not grant you ownership of Jaalva's intellectual property.

You may not copy, sell, redistribute, reverse engineer, or commercially exploit protected portions of Jaalva except as permitted by law or with permission.

Jaalva respects intellectual-property rights.

Copyright owners or their authorized representatives may report alleged infringement using the procedure described in Jaalva's Copyright/DMCA Policy.

Jaalva may remove or disable access to allegedly infringing material and may take action against repeat infringers as required by applicable law and Jaalva policy.

Jaalva relies on third-party infrastructure and technology providers to operate portions of the Service.

These providers may process information as necessary to provide their respective services.

Our Privacy Policy will explain relevant categories of service providers and processing in greater detail.

If you voluntarily provide suggestions, bug reports, ideas, or other feedback about Jaalva, you permit us to use that feedback to develop, improve, and operate Jaalva without compensation or obligation to you.

This does not transfer ownership of unrelated User Content.

Jaalva is provided during pre-alpha on an "as is" and "as available" basis to the extent permitted by law.

We do not guarantee uninterrupted availability, error-free operation, preservation of content, compatibility with every device, or that every feature will continue to exist.

You should maintain copies of content that is important to you.

To the maximum extent permitted by applicable law, Jaalva disclaims warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Jaalva and its Operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Service.

Nothing in these Terms limits liability where such limitation is prohibited by law.

Because Jaalva is presently a closed pre-alpha service offered for testing, users acknowledge that software defects, interruptions, and data loss are possible.

You may stop using Jaalva at any time.

Jaalva may suspend, restrict, or terminate an account for violations of these Terms or the Community Guidelines, security concerns, legal requirements, abuse prevention, or material risks to Jaalva or its users.

Certain provisions of these Terms that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, and dispute provisions—will continue to apply.

Jaalva will change substantially during development.

We may update these Terms as the Service evolves or legal requirements change.

When we make material changes, we may provide notice through Jaalva, email, or another reasonable method.

Continued use after revised Terms become effective constitutes acceptance where permitted by law. Where applicable law requires affirmative consent, we will obtain it.

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms deprives a consumer of protections that cannot legally be waived.
